WHAT VISA CHOOSE TO settle IN BRAZIL?

For those wishing to settle in Brazil, the Brazilian government offers several types of visas that allow you to live, work, study, or invest in the country legally.

The different types of visas

In addition to the temporary visas, there are other visa allowing you to stay in Brazil, such as the visit visas, diplomatic, official, courtesy, or visa medical.

In this article, we'll detail the two visas that we have been able to obtain. Thanks to my job, I have (Lény) obtained a work visa (VITEM V) for a period of two years. For its part, Yaëlle has made the application ofa visa for family reunification (VITEM XI), which is attached to my work visa and, therefore, has the same validity period.

The visa application is a process that can be lengthy, it is best to plan accordingly and prepare for it in advance.

The visa work (VITEM V)

The first step to get a work visa is to find a brazilian company ready to hire you.

The company will then begin the process by submitting an application for authorization to work in the government within the "Ministério da Justiça e Segurança Pública" (MJS).

This authorization is a prerequisite so that you can then apply for your visa. The company must provide a file explaining the reasons for hiring and to prove that the foreign applicant has the qualifications and experience required for the position. This folder should include information on the contract for the proposed work as well as your academic, professional certificates and your work experience to prove your skills.

Once the work permit has been approved by the GMS, it is forwarded to the ministry of foreign affairs (" Ministério das Relações Exteriores "), of Brazil, which will then send the authorization to the Consulate-General of Brazil. You will then be able to start the procedures for the application for a visa at the Consulate General of Brazil (Paris, Marseille, Cayenne, Sydney, Pretória) depending on your place of residence, you will find your here.

If you're lucky, the company that hires you will call on the services of a law firm specializing in immigration to make the process easier. They take charge of the entire administrative process, which greatly simplifies the procedure. They will take care of everything, you have nothing to do apart from providing the required documents.

Here is the list of documents required for the visa-application work :

  • Electronic form visa application filled.
  • Valid passport (valid at least 6 months after the date of departure, with at least two blank pages).
  • Identity Photo with the dimensions of 3×4 cm, consistent with the official standards.
  • Full copy or extract of the birth certificate, duly apostilled.
  • Extract from the judicial record dated within the last 90 days, duly apostilled.

Visa for family reunification (VITEM XI)

Visa for family reunification allows members of the immediate family (spouse, children, parents) to join a brazilian citizen or an alien who holds a residence permit in Brazil. This visa also allows you to work legally in Brazil.

Documents required for visa for family reunification are :

  • Electronic form visa application filled.
  • Valid passport of applicant (valid at least 6 months after the date of departure, with at least two blank pages).
  • Original or certified copy of the identity document of the holder of a residence permit in Brazil.
  • Full copy or extract of the birth certificate, duly apostilled.
  • Photo identification of the applicant, consistent with the official standards.
  • Visa of the foreigner holding a residence permit in Brazil.
  • Document proving the family relationship between the applicant and the holder of a residence permit in Brazil (birth, wedding, PACS...).
  • Extract from the criminal record of the applicant and dated within 90 days.
  • One of the two following statements in the function of the family relationship :
    • For family reunification of spouses : A joint declaration on honour, signed by the two partners, confirming their common life and their project to reside in Brazil.
    • For family reunification in other cases : A declaration on honour the holder of a residence permit in Brazil than it already resides or will reside in Brazil.
    • Note : These statements must be signed by the declarant and the person face-to-face with the Consulate-General of Brazil. If the presence at the Consulate General is impossible, the signature must be certified by a notary or the town hall. If the spouse resides in Brazil, certification must be made by a notary public (" cartório ") in Brazil.

Information on the documents required for the visa application

Important : recently, birth certificates must be apostilled. The apostille is a certification that validates your documents for use internationally. You can request the certificate from the court of appeal, which depends on your local city of birth. The documents apostille can be sent by post or can be deposited directly on the spot accompanied by the document Cerfa 15703*01 completed and signed.

A full copy of or extract of your birth certificate is to ask at the town hall of your city of birth. For most of the municipalities, the application can be done directly on their website and the document will be sent to your home address via post. 

Small council: the application of a birth certificate and apostille of documents that take the most time to be, so don't hesitate to make requests as early as possible.

The application of the criminal record is directly made online on the website of the ministry of Justice accessible here. The document is generated on the fly and sent to you by email.

When you make your request from France, it is not necessary to translate your documents in Portuguese. On the other hand, if you file your application directly Brazildocuments such as the birth certificate and the certificate of criminal record should be translated by a sworn translator.
